Terms of service

These terms apply when you use novakgs.com or request a quote from BUCK2NINETY LLC, doing business as Novak Geospatial Solutions (“Novak GS,” “we,” “us”). By using the site, you agree to them. Paid work is governed by a separate written services agreement; if that agreement and these terms ever conflict, the services agreement controls.

Using this website

You're welcome to browse the site and use our quote form for genuine project inquiries. Please don't misuse it: no spam, automated scraping, attempts to break or overload the site, or uploading files that contain malware or content you don't have the right to share.

Quote requests

Submitting a quote request doesn't create a contract or commit either of us to anything. We'll review your request and follow up, usually within one business day. A quote is an estimate based on the information you provide. Its price, scope, and schedule become binding only when both parties sign a services agreement, and a quote may change if site conditions, access, scope, or regulatory requirements turn out to differ from what was described. Quotes are valid for 30 days unless they say otherwise.

By submitting the form, you confirm that the information is accurate and that you have the right to share any files you attach. You also agree that we can contact you about your request by the method you chose.

Our services

We provide aerial imagery, maps, measurements, and related geospatial data products. Flights are conducted by an FAA-certified remote pilot under 14 CFR Part 107. Each project is planned around safety and the law, which means:

• Weather and safety come first. We may postpone or cancel a flight for weather, airspace restrictions, equipment issues, or any condition we judge unsafe. Rescheduling for these reasons is not a breach.
• Access and permission. The client is responsible for ensuring we have permission to access and fly over the property, unless we've agreed otherwise in writing.
• Airspace. Some locations require FAA authorization, which may affect timing or whether a flight is possible.

Not a land survey

Our data products are for planning, measurement, documentation, marketing, and decision support. They are not a land survey, and we do not provide professional land surveying or engineering services under Wisconsin law. Our maps and data don't establish property lines, boundaries, easements, or legal descriptions, and they shouldn't be used where a licensed professional land surveyor or engineer is required. Measurements, including volumes, carry tolerances that depend on site conditions, ground control, and methods, and we'll describe the expected accuracy for your project in the deliverables.

Content and intellectual property

Novak Geospatial Solutions™ is a trademark of BUCK2NINETY LLC, registered with the State of Wisconsin. The name, logo, website design, text, and imagery on novakgs.com belong to us and may not be copied or used without permission. Ownership and licensing of project deliverables are set out in each client's services agreement.

Third-party services and links

The site uses outside services, such as OpenStreetMap for maps and address search, and may link to other websites. We aren't responsible for their content, availability, or practices.

Disclaimers

We work to keep this website accurate and available, but it's provided “as is” without warranties of any kind, to the fullest extent the law allows. General information on the site, such as service descriptions and examples, isn't professional advice for your specific project.

Limitation of liability

To the fullest extent the law allows, Novak GS won't be liable for any indirect, incidental, special, or consequential damages, or for lost profits, arising from your use of this website or a quote request. Our liability for paid services is governed by the services agreement for that project.

Governing law

These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute arising from them will be handled in the state or federal courts located in Dane County, Wisconsin.

Changes to these terms

We may update these terms from time to time. The “last updated” date above shows when they last changed, and continued use of the site after a change means you accept the updated terms.
